Canadian divorce law has operated under a no-fault system since the mid-1980s. This meant that the actions of one spouse during the marriage, including issues such as infidelity or abusive behavior, were not taken into account when dividing assets or determining spousal support. The May 2026 Ahluwalia decision from the Supreme Court of Canada may impact the no-fault system, marking a dramatic turning point for divorce law in Canada. This week we discuss a case on civil contempt: 2023 ABKB 58 https://canlii.ca/t/jv6jd In the case, the ex husband is found in civil contempt for failing to comply with a court order and arbitration award. The problem? He refused to remove a Certificate of Pending Litigation (lien) on title to one of the parties' real properties. The court ordered that the ex husband be imprisioned until he purged his contempt (dischared the lien from title). It's an extreme remedy for an extreme set of circumstances.
